Judge assigned to Chagra case

SAN ANTONIO — Jimmy
Chagra, charged with conspir
ing to kill a federal prosecutor,
Tuesday laughed in disbelief
when told the case was randomly
assigned to his old foe — U.S.
Judge William Sessions.

O’Connor formally charged

in the Nov. 21, 1978 attack on

Kerr.
O’Connor informed Chagra
the case would be heard by Ses
sions, who sentenced Chagra to
47 years in prison for drug traf
ficking, income tax evasion and
conspiring to obstruct the inves
tigation of the 1979 death of
U.S. Judge John Wood Jr.
“Does my name go into a
tumbler and a certain judge get
my case? How do I get Judge
Sessions every time?” Chagra
asked O’Connor. “It’s supposed
to be a random thing. Do judges
pick who they want to prose
cute?”
Assistant U.S. Attorney Ray
Jahn, who conducted the Wood
investigation, told the court that
Chagra’ case was randomly
assigned to Sessions.
Chagra laughed skeptically,
asking O’Connor, “it was rando-
ly picked?”
Chagra waived his right to
have a bond set in the case, and
O’Connor granted a request to
appoint Las Vegas, Nev., attor
ney Oscar Goodman as defense
counsel. No arraignment date
was set.
Kearns, 44, was brought be
fore O’Connor in a seperate
hearing and charged with con
spiracy and assaulting a federal
prosecutor.
The indictments alleged that
Chagra arranged through an
associate, Robert Piccolo, to hire
Kearns to kill Kerr, who was in
vestigating Chagra’s drug deal
ing activities.
The indictment said Kearns
fired “numerous rounds” from
a semi-automatic, .30 caliber
rifle at Kerr’s car. Kerr escaped
serious injury by ducking be
neath the dashboard.
Chagra is serving his sent
ences at the federal prison in
Marion, Ill., while Kearns is
serving an 18-month sentence in
Concord, N.H., for theft from
an interstate shipment.

EL PASO — Accused mur
derer Keith Webb broke down
and cried after he led FBI agents
to his six-year-old son’s shallow
grave in the desert.
“There’s Stevie,’” FBI agent
David Beiter quoted Webb as
saying in trial testimony before
U.S. District Judge Harry Lee
Hudspeth.
Dr. William Liles, an Army
pathologist who examined the
boy’s remains, testified Monday
that the body Webb led agents to
was that of Steven Marcel Wil
son, and that homicide was the
probable cause of death.
Beiter said he and another
agent took custody of Webb at
the Criminal Investigations Di
vision office at Fort Bliss last
Sept. 6.
Agents testified Webb led
them to the site of the shallow
grave, at a spot in the New Mex
ico desert, one mile north of the
Texas line. They said they saw a
portion of an uncovered skull of
a human, then the rest of the
decomposed remains of a child’s
body.
On the trip back to El Paso,
Webb decided to talk to the
agents about the circumstances
surrounding the boy’s death,
Beiter said.
“Webb said that the boy had
died about one month before,
on Aug. 12, at the residence
Webb snared with his wife, June
Webb, located at Fort Bliss,” the
agent said.
“He told us that two or three
days before the boy’s death, the
boy stole something, and to pun
ish him, the boy was put in hot
water,” Beiter said. “Afterward,
he put the boy in bed, and
climbed into the bed to console
him.”
On the day the boy died, Bei
ter said Webb and the boy were
in the house alone when Webb
picked up the boy from his bed,
where he was lying in a lethargic
state, and carried him to the
kitchen, where he gave the boy a
cookie. The boy fell over dead,
the agent quoted Webb as
saying.
Webb told agents he wrapped
the boy in a blanket, put him in a
storage shed at the residence

him before a magistrate. He said
he was taken into police custody
