Secret
witness
testifies
United Press International
AMARILLO — The prosecu
tion indicated Tuesday it w ill call
a “secret” witness later this week
to testify in the conspiracy to
commit capital murder trial of
Amarillo attorney Jim Durham
Jr-
Special prosecutor Douglas
Mulder said he would not re
lease the name of the witness,
who is one of several witnesses
listed in pretrial documents who
has not testified yet, “because he
fears for Ins life.”
The witness will not testily
until Thursday, under a special
arrangement approved by Dis
trict Judge Bill Sheehan, be
cause that is the earliest he can
get to Amarillo, Mulder said.
The defense rested its case
Tuesday in the trial without call
ing the defendant to testify.
Durham, 42, is accused of help
ing plan the 1977 murder of
Amarillo clothier Frank Potts.
George and Bedale Hicks,
who have both been sentenced
to 99 years for killing Potts, said
they w'ere paid $5,000 to per
form the slaying for Potts’ busi
ness partner Kevin Francis, who
they said wanted to collect on a
$175,000 life insurance policy.
They said Durham helped
plan the murder.
A former Potter County jailer
testified Tuesday Mrs. Hicks
was given preferential commis
sary treatment in the jail after
she agreed to testify in the trial.
Alice Fay Bonner said she was
instructed by ( .apt. Eddie Kirk
wood of the Sheriffs office to
obtain items from the commis
sary for Bedale Hicks whenever
she wanted them, though other
prisoners were only allowed to
purchase items two days a week.

drill held
United Press International
AUSTIN — The state’s Divi
sion of Emergency Management
will participate Wednesday in an
emergency preparedness drill
for the Commanche Peak nuc
lear power plant near Glen
Rose.
Coordinator Robert Lans-
ford said Tuesday the drill is
part of the criteria the plant —
owned by Texas Electric Ser
vices Co. — must meet to receive
an operating license.
Lansford said the scenario
for the drill has not been re
leased to participants.
“Our operation for exercise
will be essentially the same as for
any other exercise or real
