ISStfn Battalion Classified Call 845-2611 Page 12/The Battalion/Thursday, November 3, 1983 KKK, ACLU attack Austin parade rules United Press International AUSTIN — The Texas chap ter of the American Civil Liber ties Union, in behalf of the Ku Klux Klan, asked a federal court Wednesday to declare Austin’s 4-month-old parade ordinance unconstitutional. The class action suit was accompanied by a similar but separate suit Filed by the Legal Aid Society of Central Texas on behalf of the Black Citizens Task Force. The court did not set a hear ing date for either complaint. The city adopted the ordi nance after a violent KKK march last Feb. 19 that turned into a near riot. Eleven people were injured and 13 arrested during the march, which drew about 70 Klansmen and more than 3,000 hecklers. No mem ber of the Klan was arrested in the march. Police said the march cost the city $69,000 in extra personnel, equipment and planning. The Klan asked the Texas Civil Liberties Union for assist ance after Austin turned down the Klan’s request for a permit to parade Saturday. “There are a number of pro visions in the Austin parade ordinance that are unconstitu tional,” TCLU lawyer Edward Sherman said. The complaint challenged the provisions of the parade ordinance that require: • A parade applicant must be a resident of Austin. • There be a 20-day lead period to get a permit. • A group must have 200 par ticipants. • A group is limited to only one parade per year. The complaint also claims that the permits are issued at the discretion of the city manager, who must determine if there is “sufficient interest.” -■ The state capital should be open to all citizens of Texas to parade, Sherman said, and free speech can’t be bottled for 20 days. Groups with fewer than 200 marchers still have a right to free speech, he said. The Klan is not pushing to march Saturday, Sherman said.
