DeLorean videotapes to be aired

LOS ANGELES — An
appeals court Sunday threw out
an order that blocked CBS from
broadcasting duplicates of gov
ernment videotapes showing the
surveillance and arrest of John
DeLorean in his cocaine traf
ficking case.
The network said it would air
the tapes Sunday night.
Attorneys for the former
automaker said they would im
mediately appeal to the U.S.
Supreme Court in hopes of
heading off the broadcast.
U.S. District Court Judge
Robert Takasugi Saturday
issued the order prohibiting
CBS and its affiliate, KNXT,
from broadcasting the tapes.
After an emergency hearing
Sunday, a three-judge panel of

the Ninth Circuit Court of
Appeals unanimously voted to
overturn Takasugi’s order.
William Vaughn, an attorney
for CBS, said Takasugi had
overstepped legal bounds in
making his ruling.
“He has no constitutional
power to do what he did,”
Vaughn said. He said the case
involved a “familiar collision”
between a defendant’s right to a
fair trial and freedom of the
press.
But Howard Weitzman, De-
Lorean’s attorney, said, “I’m
afraid the balancing is going to
be ratings versus a fair trial.”
“The horror I see arising is
there’s no way John DeLorean’s
going to get a fair trial.”
He said airing of the
videotapes would result in a bliz
zard of publicity and “unleash a
circus unprecedented injudicial
history.”
DeLorean, who is free on $5
million bail, was scheduled for
trial Nov. 1.

Prosecutor James Walsh
joined defense attorneys in
asking the court to uphold
Takesugi’s order to block airing
of the tapes.
“I don’t see the need to
jeopardize the appropriate dis
charge of a case that has dragged
on now for a year,” Walsh said.
He said the tapes would be made
public in two to three weeks once
they are introduced as evidence,
and CBS’s desire for a “scoop”
should not be allowed to possibly
force a delay or relocation of the
trial.
“They’re dynamite — or at
least that’s what they are per
ceived to be,” Walsh said.
“That’s why they want them out
now.”
But Vaughn insisted it was a
question of constitutional rights.
“If CBS is restrained for even
an hour, or a day, then you have
a clear violation of the Constitu
tion,” Vaughn said.
At one point attorneys were
scolded for allowing the tapes,
which were under seal, to get
into the hands of the news
media.
In a letter to Takasugi, Weitz
man claimed KNXT was given
duplicates of the tapes by Hust
ler magazine publisher Larry
Flynt. CBS officials declined to
say how the network got its
copies.
Assistant U.S. Attorney Layn
Phillips, a prosecutor in the case,
said his office had called in the
FBI to thoroughly investigate
the matter, and intends to pur
sue all possible leads to find the
leak.

FAIRVIEW, Okla.— Offi
cials Sunday removed an over
turned truck that leaked prop
ane gas and closed a highway
north of Fairview.
The leaking gas forced the
closing of a mile-long stretch of
U.S. 60 from just north of Fair-
view to the State Highway 58
junction in Fairview Saturday.
Several businesses also were eva
cuated.
Fairview Fire Chief Mike
Howerton said a semi-trailer
truck accidentally forced a truck
loaded with 9,000 gallons of li
quid propane into a ditch. He
said the collision punctured the
propane tank, permitting the
gas to escape.
The propane truck was own
ed by United LP Gas of Texas,
Howerton said, and was driven
by Jack Clifton. The driver of
the semi-trailer rig was injured,
he said.
