Austin attorney
gets bail case

AUSTIN — A state court
judge Monday appointed one of
Austin’s top criminal defense
lawyers to represent former
Texas Supreme Court Justice
Donald Yarbrough in his bail
jumping case.
Yarbrough, his hair unkempt
and needing a shave, made two
brief courtroom appearances
Monday and is scheduled to
appear in court again next
Monday.
Yarbrough, 41, who was clad
in a green prison uniform, de
clined to comment to reporters
as he was led in and out of the
Travis County Courthouse.
His court-appointed lawyer,
Charles Burton, said Yarbrough
signed an affidavit, affirming to
District Judge Mace Thurman
Jr. that he could not afford to
hire a lawyer.
Burton said he met briefly
with Yarbrough, but reached no
decision on how the case will be
handled.
Yarbrough was extradited
March 18 from the Caribbean
island nation of St.Vincent to
Austin after 19 months as a fugi
tive.
He was sent immediately to
Huntsville to begin serving his
Five-year sentence for a 1978
perjury conviction.
A second indictment charg
ing Yarbrough with bail jump-
irig was returned last week by a
grand jury to correct the mis
spelling of his name in the ori
ginal indictment.
He was convicted of lying to a
grand jury that was investigating
charges that he planned to have
a Victoria banker killed to keep
him from testifying in civil law
suits regarding Yarbrough’s
Financial dealings.
Minorities fight
forced busing

DALLAS — The 12-year Dal
las school desegregation case en
ters yet another round this \veek
with scheduled debate before
the 5th U.S. Circuit Court of
Appeals on a proposal to allow
minority students to drop out of
court-ordered busing.
School board lawyers main
tain minority students should
have the right to attend neigh
borhood schools, if their parents
so choose, irrespective of busing
plans.
Lawyers for the original
plaintiffs and the NAACP con
tend the so-called “minority
neighborhood option plan”
would aggravate segregation in
a district where 89 out of 171
schools are already primarily
minority.
Debate on the plan is sche
duled for Wednesday before the
New Orleans-based 5th Circuit.
The school board is appealing
Dallas federal judge Barefoot
Sanders’ 1982 desegregation
order, which rejected the neigh
borhood option plan.
During the 1981 trial that led
to Sanders’ order, several
minority parents testified they
wanted to end busing and re- ,
turn their children to schools in
their neighborhoods. •
Sanders’ order has 11,000
children — mostly in grades 4
through 8 — transported for de-»
segregation purposes.

board and minorities, parents of *

UAW readies
for labor deal

DETROIT — The United
Auto Workers hopes to have an
outline of a labor agreement
with General Motors Corp. and
Toyota by its May 15 convention
in Dallas, a trade publication re
ported Monday.
Automotive News quoted a
union spokesman as saying the
proposed agreement will be only
a framework for a possible
agreement if and when the Fed
eral Trade Commission
approves the deal.
FTC Chairman James C. Mil
ler III said in Detroit last week
the commission should rule on
the proposed joint venture in
about 60 days.
GM and Toyota have
announced plans to jointly build
subcompacts at GM’s vacant
assembly plant in Fremont,
Calif. The venture is expected to
employ about 3,000 workers.
The union has said it will be
the' bargaining agent for those
workers, a contention that is
supported by GM. However,
Toyota officials have said they
want to have a “free hand” in
hiring at Fremont.
The venture is contingent
upon the negotiation of a labor
agreement. But it has not been
made clear by any of the parties
involved whether laid-off Fre
mont workers will have first re
call rights at the plant.
Sailors schedule
survivors’ reunion

ARLINGTON — For only the
second time in 38 years, surviv
ing sailors assigned to the USS
Little, a destroyer which sank in
one of the final battles of World
War II, will compare recollec
tions of the kamikaze attacks
that split their ship and took 30
lives.
As many as 50 former sailors
are expected for the three day
event.
Besides exchanging stories
and renewing acquaintances,
participants will hear Sen. John
Tower, R-Texas, a former Navy
enlisted man, give a speech
Saturday evening.

which the swarm of Japanese
fighter planes made kamikaze

The car sustained only minor

The driver then got out of the
car and told the 16-year-old

call the police. He then waited at
the scene until officers arrived.
