Kerr’s ruling in November that the windfall profits tax is uncon stitutional. In January, the court had re jected the justice department’s request for expedited consider ation of the appeal and in Febru ary had agreed to consider the case under usual procedures. That would have meant the arguments would have been heard next term and the a ruling would probably be handed down next year.
