The governor, who cam paigned on a promise to make the PUC more responsive to ratepayers, has claimed the panel is a “lap dog” to the utility industry. “One thing I can assure you, the Texas Public Utility Com- piission as it exists now is not a captive of the utility industry,” Erwin said Wednesday. The case dates to 1956, when a group of black parents filed suit to desegregate schools in the district. The parents challenged overlapping racially segregated attendance zones. The 5th Circuit agreed with a U.S. district judge in Texas that the school district has become desegregated after 25 years of court proceedings and 12 years of court supervision under a court-ordered desegregation plan. The appeals court received the case after the trial judge re fused a request to add 26 defen dants and seek an inter-district remedy which would force stu dents from the predominantly white suburban districts to attend school in Houston, while Y1\SY> students went to the sub urban districts.
