granted greater protection to
home buyers, ruling builders
who give warranties on houses
can be held liable for problems
which develop after the house
has been resold.
The Supreme Court said
Wednesday that the effect of
faulty construction on the subse
quent owner is just as great as on
the original buyer, and the buil
der is no more able to justify his
improper work as to a subse
quent buyer than to the original
buyer.

The homebuilder was sued
by Gupta, who claimed a faulty
foundation caused the walls to
crack, the roof to leak and the
patio to separate f rom the rest of
the house.
In a concurring opinion, Jus
tice Franklin Spears said latent
delects in a house are unlikely to
be noticed until alter the origin
al owner has sold the house.
“In our very mobile society, a
builder-seller should know a
house he builds might be resold
within a very short period of
time; therefore, our extension
of the implied warranty should
not place any extra burdens on
builders,” he wrote.
The court also agreed to de
cide whether the former dire
ctors of a Woodson bank mis
represented the financial condi
tion of the hank before they sold
a controlling interest in it to
Tommy Ballard.
A trial court jury awarded
Ballard $228,599 in damages
against ex-directors Bill King,
Cecil King, Zanna Anderson
and Marvin Bellah.
But the 11th Court of
Appeals overturned the award
on grounds that the trial court
