NEW ORLEANS — The na
tion’s largest lawyer’s group is
sticking with its ethics code
which limits when an attorney
must reveal a client’s secrets to
protect the public.
The American Bar Associa
tion’s policy-making body Mon
day rejected changes in the
lawyer’s ethics code that would
have expanded the circumst
ances under which attorneys
could break client confidences.
Delegates were urged to re
quire lawyers to disclose client
secrets to prevent fraud, serious
financial harm or imminent
physical danger. The current
lawyer’s ethics code, adopted in
1969, asks lawyers only to dis
close confidences to prevent a
crime. The only other exception
to the client secrecy rule is when
a lawyer is disputing fees with a
client.
Under the proposal, which
died on a 207-129 vote, a lawyer
would have been called on to
violate the traditional lawyer-
client privilege in cases when he
reasonably believed there would
be substantial injury to the
financial interests of another or
to rectify the consequences of a
client’s criminal or fraudulent
act.
The privilege permits a
lawyer to keep silent on any
communications from a client
while legally representing him.
The action during the ABA’s
mid-winter meeting leaves intact
existing ethical rules, which bar
a lawyer from disclosing client
secrets in virtually all circumst
ances.
Under the standards of the
profession, however, lawyers
may reveal confidences in a fee
dispute or to protect individuals
from death or imminent bodily
harm.
Opponents of the ckt
