AUSTIN — The Texas
parole board is scheduled to
open hearings Sept. 20 to decide
whether the parole of prison
activist David Ruiz should be re
voked, despite his acquittal last
week of robbery charges.
Board members voted 2-1
Tuesday to direct their hearing
examiner to review the evidence
in the November 1981 robbery
of an Austin nightspot, and re
commend whether Ruiz should
be returned to prison.
Ruiz, 40, was paroled in June
1981 after serving 12 years of a
25-year robbery sentence. If his
parole is revoked, he would face
another 13 years in prison.
Ruiz successfully sued the
state Department of Corrections
in federal court over inmate liv
ing conditions while he was in
prison.
During his nearly month
long trial on the Austin robbery
charge, Ruiz claimed he was a
victim of a conspiracy by TDC
because of his role as an inmate
advocate.
Parole board attorney Chuck
Walker said the panel’s vote to
consider the robbery evidence is
not “an indication of the way the
board feels about this.”
“They certainly have not
made up their minds that David
Ruiz is guilty,” he said.
