U.S. District Judge Norma Holloway Johnson dismissed a lawsuit Monday filed by the in mates, rejecting their argument that without approval by the Food and Drug Administration such injections are illegal. David Kendall, lawyer for the inmates, said the ruling affects death row inmates in four states where lethal injections are per mitted — 146 inmates in Texas, 39 in Oklahoma, four in New Mexico and five in Idaho. In her ruling, the judge said the FDA is not required to approve the use of the lethal drugs for death penalty cases. Avery had been fired from the plant Aug. 19, but officials declined to give the reason. “He was terminated at that time and made some threats to some other employees at the IBM facility,” said Durham County Sheriffs Department Capt. Tommy King. Pandich said neither of the victims was Avery’s supervisor. He said he did not know if Avery knew either of them. “It appeared to be random,” he said. A former neighbor who would not give his name, said Avery had a wife and children, although reporters were unable to find them. He said Avery told him he served two tours of duty in Vietnam, had been exposed to Agent Orange and was undergoing treatment for stress.
