CINCINNATI — A federal
appeals court Tuesday rejected
a controversial student assign
ment plan designed to put an
end to segregated schools in
Nashville, Tenn., and surround
ing Davidson County.
The 6th U.S. Circuit Court of
Appeals, in a 2-1 decision, said
the plan did not sufficiently im
prove racial balance in the coun
ty-wide district to meet constitu
tional standards for desegrega
tion.
Appellate Court Judges
George C. Edwards and Natha
niel Jones said the plan designed
by Nashville U.S. District Court
Judge Thomas Wiseman left
elementary schools in the
67,000-student system “highly
segregated,” and did not adequ
ately integrate high schools and
middle schools.
T he majority
suggested Wiseman was]
concerned with preil
“white flight” and pres
neighborhood schools, n
the district judge’s detis
accept a 15 percent minimi
either race in middle;
schools.
“This figure is cleaiil
acceptable as a startingpoT
school system thathasa5|
cent white/32 percent!
cial composition,” theail
court majority said.
The majority judges a|
versed as unconstitutional
man’s exclusion of kindei
through fourth- or fifii
students from the pup
signment plan.
Wiseman’s
order, the majority judge
tinued, “would serve to
