Judge delays execution
of convicted murderer

AUSTIN — A federal judge
Tuesday issued a stay of execu
tion for convicted murderer
Charles Rumbaugh, delaying
his execution, scheduled for
midnight Thursday.
A federal court clerk in
Houston said Judge George
Cire issued the stay after meet-

ing with attorneys for Rum-
baugh’s parents and the state.
Details of the stay order were
not available, but it was thought
to extend until Rumbaugh is
given a competency hearing.
Rumbaugh’s parents have
contended that their son is not
mentally competent and unable
to waive his rights of appeal.
Rumbaugh, 25, was con
victed of the 1975 murder of an
Amarillo jeweler. He has re
fused appeals and Monday the
Texas Court of Criminal
Appeals denied a request for a
stay of the execution filed by his
parents, Rebecca and Harvey
Rumbaugh.
Had the federal court de
clined to give Rumbaugh a stay,
the parents could have re
quested that Gov. Bill Clements
act to halt the execution. A
spokesman for Clements said
the governor is given a back
ground file on any convict
whose date for execution has
been set. The Clements spokes
man said the governor had stu
died Rumbaugh’s filejust in case
he became involved in the case.
If the execution were carried
out, it would be done by lethal
injection rather than electrocu
tion. There has not been an ex
ecution in Texas since 1964.
Currently, 165 men and two
women are facing the death
sentence in the state.
Rumbaugh wrote a letter to
Randall County District Judge
George Dowlen June 11 asking
that his execution not be de
layed. In the letter, he said the
jury had decided he was a “de
fective humanoid who must be
eliminated.”
Rumbaugh was convicted of
killing Michael Fiorillo on April
4, 1975, during a holdup of
Fiorillo’s jewelry store.
