Juror’s charges end trial

CLEBURNE — A district
attorney confirmed that a state
senator was named as receiving
the services of prostitutes, but
the name may never be revealed
because a mistrial was declared
in the case of three men accused
of operating massage parlors.
State District Judge C.C.
“Kit” Cooke declared a mistrial
Monday for Aubrey Joyce Estes
Jr., 50, of Midlothian; and John
Binion Cook, 27, and Hayden
Walter Tomlinson, 23, both of
Burleson.
The men were being tried on
charges of organized crime and
aggravated promotion of pros
titution. The mistrial came after
a juror alleged a lawyer and the
three defendants visited him at
the freight company where he
worked.
Johnson County Attorney
Dan Boulware confirmed a state
senator consorted with one of
the defendants and received
prostitution services from some
of the girls named in the case,
according to a report in the Fort
Worth Star-Telegram.
Boulware declined to name
the senator.
Juror Jesse McIntyre claimed
the defendants and Estes’ attor
ney, Mike Rogers, visited him at
the Freight Masters office in
Fort Worth a week before jury
selection. McIntyre told officials
Tomlinson said he knew McIn
tyre was scheduled for the jury
and said: “I just wanted you to
know I’m innocent.”
Attorneys denied McIntyre’s
claims. Rogers said the official
jury list was not available at the
time McIntyre said they visited
him.
Boulware said the Texas Ran
gers and DPS investigators were
questioning jurors about possi
ble perjury and jury tampering.
Officials said a grand jury
would consider possible
charges, against McIntyre or
others, on Friday.
Untidy apartment
cause for eviction

DALLAS — A community ac
tion group has waded into the
fight to keep the Dallas Housing
Authority from evicting a tenant
from her rent-subsidized apart
ment for untidy housekeeping.
The Association of Commun
ity Organizations for Reform
Now protested the eviction of
Dorothy Wilson, 49, from her
west Dallas apartment Monday
at a news conference in the
office of project manager Carlos
Garcia.
Wilson has lived at the project
since 1978 and is current in her
$15-a-month rent, but Garcia
said her poor housekeeping
violates her lease.
“The only thing she has done
is not keep her house clean,”
said ACORN spokeswoman
Dorothy White. “There are a lot
of homes like this with only a
little path through them. Why
pick on her?”
Garcia said Wilson had lost
two appeals and was due to leave
Monday. He said he would give
her another week, but she would
have to leave.
“We have to put our foot
down somewhere,” Garcia said.
“We have been working with this
lady since April. We do have to
evict people who don’t abide by
the rules.”
Agency director Jack Her
rington said Wilson’s eviction is
part of a general crackdown on
lease violations. He said 157 of
the residents at the agency’s
6,000 apartments have been
evicted so far this year, com
pared with 280 for 1981.

Kidnapped baby
returned to mom

GALVESTON —A 1-day-old
baby taken from her mother’s
arms almost a week ago by a
woman pretending to be a nurse
was returned early Tuesday, a
spokeswoman for John Sealy
Hospital said.
The baby, Christina Lynn
Lewis Haynes, was in excellent
condition, medical personnel re
ported at a news confernce.
Her mother, Carolyn
Haynes, was near tears as she
told reporters she was happy at
the return of her kidnapped
child and wished the un
apprehended abductor would
seek help.
Haynes, of Beaumont, did
not show any anger toward the
abductor and said, “I hope she
gets some help if that’s what she
needs.”
The baby was taken from her
mother’s arms July 13 by a
woman dressed in a surgical uni
form.
She was returned early this
morning to the Galveston Police
Department by a man and a
female companion, police said.
