The case awaiting action at the high court confronts thejus- tices with a broader question, testing whether companies that handle radioactive material can be sued for punitive damages amounting to millions of dollars. In 1979, a federal court jury in Oklahoma City awarded Silk- wood’s estate and children $10 million in punitive — punishing — damages and $500,000 in personal injuries. But the 10th U.S. Circuit Court of Appeals in Denver overturned that judgment last December, concluding the 1954 Atomic Energy Act prohibits states from authorizing such punitive damage awards. “The nuclear industry was in itially developed by the federal government, is closely linked with national security, and is ex tensively regulated by a federal agency,” the appellate panel noted. “It does not matter whether Kerr-McGee violated regula tions in the conduct of its plant operations.
