CIA head Casey
cleared in probe

WASHINGTON — A Justice
Department investigation found
that CIA Director William J.
Casey did not violate the Fore
ign Agents Registration Act
while working as a lawyer repre
senting Indonesia in 1976, it was
disclosed Thursday.
Attorney General William
French Smith said the govern
ment’s probe cleared Casey of
any violation in connection with
his work as a private lawyer for
the Indonesian government.
“At all times, the fact that Mr.
Casey was representing Indone
sia was made clear to those offi
cials with whom he was dealing,”
said Smith. “The evidence does
not support a conclusion that at
any time Mr. Casey sought to
persuade or influence officials
to change any agency policy.”
The investigation found that
Casey’s representation of In
donesia was limited to efforts to
obtain an agreement with the
Internal Revenue Service as to
the changes necessary in In
donesian oil production sharing
contracts and the tax code to
make sure the payments made
under the contracts would be
creditable under U.S. law.
Smith comments were con
tained in a report Wednesday to
the U.S. Circuit Court of
Appeals in Washington, D.C.,
under the special prosecutor
provisions of the Ethics in Gov
ernment Act. A copy of the re
port was released Thursday by
the Justice Department.
Under the law, the attorney
general must open a prelimin
ary investigation after receiving
any allegations against high level
federal officials. He must seek
appointment of a special pro
secutor if the charges are not fri
volous.
A special prosecutor was
appointed under the Ethics in
Government Act last December
to investigation allegations
against Labor Secretary
Raymond Donovan. The probe
is still continuing.
But in this case, Smith said he
found the allegations involving
Casey so “unsubstantiated that
no further investigation or pro
secution is warranted” and no
special prosecution need be
appointed.
Smith said the Justice Depart
ment investigation began in
January after a Washington Post
story alleged that Casey failed to
file as a foreign agent while
working for the Indonesian gov
ernment.
Under the law, a person seek
ing any changes in U.S. policy on
behalf of a foreign principal
must register with the Justice
Department.
