But he said Thursday the language of the law was uniquely religious and not defensible. “I have spent a long time ago nizing over this decision,” Clark said at a news conference. The creation-science law would have required teachers to give balanced treatment to crea tion-science whenever evolution was taught in public schools. U.S. District Judge William Overton, who conducted an eight-day trial in December, ruled Jan. 5 that the law was a blatant attempt to teach religion in schools. He said the concept of creation-science had no basis except the account of creation in Genesis and had no scientific evidence to back it up. James Rice of Dallas, who pleaded innocent to charges he killed his former Air Force roommate, have failed in an effort to have the case trans ferred out of Texas. Rice’s attorneys asked Col. Kenneth Randall, the military judge in the case, to transfer the rare court-martial out of Texas because of extensive publicity, refused but Randall Wednesday. The judge also denied de fense motions to exhume the body of 2nd Lt. Stephen M. Scherp of Vernon Hill, Ill., for further testing and to suppress statements made by Rice to psychologists and military police after his arrest.
