final laugh
in tax case

DENVER — A federal appeals
court says a taxpayer who gets paid
in silver dollar coins is going to get
a bigger tax bill than one who re
ceives plain paper money.
The 10th U.S. Circuit Court of
Appeals rejected Wednesday the
appeal of Utah attorney Gary
James Joslin, who said he received
only $200 for 20 hours of work he
spent on a client s case. Since the
money was paid in silver dollars —
worth five times their face value
— it amounted to $1,000 in the
eyes of the Internal Revenue Ser
vice.
The lawyer reported only $200
as income from the transaction on
his federal income tax return. He
was assessed a $252 tax deficiency,
which was the additional amount
of taxes due if his income from the
transaction had been regarded as
$1,000. He paid the assessment,
but then brought suit in district
court for a tax refund.
The court sided with the IRS,
not the lawyer, and dismissed Jos-
lin’s appeal.

HOUSTON — A panel of five
doctors from the University of
Texas said Thursday they found no
levels of cyanide in the water, air
or sewage in a neighborhood
where at least 10 people claim to
be suffering from cyanide
poisoning.
Dr. Marcus Key, professor of
occupation medicine at the UT
School of Public Health, stopped
short of saying the people arc not
suffering from the poisoning, but
said he was waiting for final analy
sis of blood samples taken from 28
people before issuing a statement.

Dr. Tim Oesch, a Houston
physician who first reported the
illness last week in 11 of his pa
tients and himself, said the
cyanide poison is emitted in the
air from the city’s sewage system.
Oesch suit! a company in the
neighborhood that uses cyanide in
its electroplating process is dump
ing the substance into the sewer
system, where it mixes with other
chemicals and forms the toxic gas
hydrogen cyanide.
Shirlene Bridgewater, spokes
woman for the Houston Health
Department, said Thursday that
although Key did not say what the
results of the tests were, he said
there is no reason for alarm.
“Cyanide can be found in the
blood stream of people who smoke
and is in certain foods, Bridgewa
ter said. “The symptoms people
have reported resemble other
illnesses.”
Most of the cases of cyanide
poisoning centered around the
Gulf Coast Bible College, in a
neighborhood near downtown.
