:Congressmen deny charges
of censoring television ads

WASHINGTON — Three
prominent Democratic congress-
pen have denied charges that
hey conspired to censor controv
ersial anti-liberal television com-
percials by the National Conser
vative Political Action Com
mittee.
Sen. Edward Kennedy, D-
Mass., and House Democratic
eader Jim Wright of Texas dismis
sed the accusations, leveled by
NCPAC chairman Terry Dolan, as
irandstanding and absolutely un
founded. And Sen. Daniel Moyni-
han, D-N.Y., said Tuesday that
broadcasters are going by the First
Amendment, not by what he tells
them.
Dolan told a news conference
Monday that 11 television stations
had refused to carry NCPAC com
mercials attacking the liberal vot
ing records of congressmen on the
organization’s hit list. Some of the
members conspired with the sta
tions — or pressured them — into
not carrying the ads, he said.
Wright denied the charges:

rial.”
Moynihan said his lawyers sent
a memorandum of law to New
York broadcasters last summer
advising them “stations are under
no ... obligation to sell (ads) to
groups like NCPAC” and that if
they do, libel laws would not pro
tect them.
“We did it in the most open
possible way,” Moynihan said. “I
did not give any television station
the right to do what they do. The
First Amendment does and the
Federal Communications Com
mission does. I haven’t called any
body. A large proportion of sta
tions that were requested to run
NCPAC ads refused to do so.
You’ll have to ask them why.”
But Dolan said the television
stations’ refusal to air the adver
tisements is a “serious violation ...
of (the) fundamental right of free
speech and expression as guaran
teed by the First, the Fifth and
14th Amendments.”
He said his group would file a $5
million civil lawsuit within a week
against the congressmen and tele
vision stations involved.
In addition to Kennedy, Wright
and Moynihan, Dolan named:
Sen. John Melcher, D-Mont.,
Rep. Tony Coelho, D-Calif., and
Ed Quick, administrative aide to
Sen. Thomas Eagleton, D-Mo.
Dolan did not have a complete
list of the stations involved, but
said they are in Dallas, Fort
Worth, Billings, Mont., Tulsa,
Okla., Springfield, Mass., Hart
ford, Conn., and Baltimore.
“NCPAC wants only to be given
an opportunity on a paid basis to
be heard,” Dolan said. “Either
these stations are willingly work
ing with these politicians or these
stations are succumbing to the im
mense pressure applied by these
desperate politicians.”

WASHINGTON — Lawyers
say John W. Hinckley Jr. is men
tally fit to stand trial on charges he
tried to kill President Reagan
March 30, and the scheduled
court hearing on his mental com
petency has been cancelled.
In legal papers filed Monday,
defense lawyers told U.S. District
Judge Barrington Parker they do
not believe the competency hear
ing is necessary for Hinckley to
face trial Jan. 4, 1982.
Hinckley’s lawyers have said
they intend to argue that Hinckley
is innocent by reason of insanity in
the cases.
In their legal papers, prosecu
tors said Hinckley has been thor
oughly examined since his Nov. 15
suicide attempt at the Army stock
ade at Fort Meade, Md.
“Obviously, Mr. Hinckley’s re
cent attempt to commit suicide
might raise a question as to com
petency, however, even in this
situation, the court must look to all
the facts and circumstances in
volved to determine whether such
an act demonstrates either mental

prosecutors said in their legal
