HUNTSVILLE — A Walker
County grand jury Thursday in
dicted Texas prison inmate Eroy
Edward Brown on two capital
murder charges in the April 4
slayings of two prison officials.
The indictment charges
Brown, a trusty at the time, shot
Ellis Unit farm manager Billy Max
Moore and drowned Warden Wal
lace M. Pack in a water-filled
ditch.
Prison officials said Moore
found Brown smoking marijuana
in a prison farm bam and tried to
return him to his cell.
Investigators said the confron
tation occurred when Moore was
driving Brown back to a cell, met
Pack on the way and left his vehi
cle to talk. Brown allegedly grab
bed a gun and started shooting.
Authorities say Brown got con
trol of Pack’s gun, fired shots that
fatally wounded Moore in the
head, struck Pack in the hand and
arm and Brown in the foot.
Brown had claimed he was de
fending himself against abuse by
prison officials. Prison officials
said they later locked him in a cell
nude with a mattressless bed to
prevent suicide.
Weapons tests, performed by
the FBI, showed that a bullet re
moved from Moore’s head was
fired from a .38 caliber revolver
owned by Pack, prosecutor Mark
Ward said.
Investigators have not deter
mined whether Brown got Pack’s
gun from the glove box of the war
den’s car or if Pack had the gun.
No fingerprints were found on
the gun, which was discovered
four hours after the slayings when
investigators dammed Turkey
creek, where Pack was allegedly
drowned by Brown.
