NEW YORK — James C. Day,
a former Texas legislator, was
sentenced today to four years in
prison for his part in a scheme to
defraud Libya of $1 million by
overstating his influence with high
U.S. government officials.
Day, 48, of Brookshire, Texas,
described as an associate of fugi
tive financier Robert Vesco,
pleaded with the court, “don’t
punish my family for my mis
deeds.’’ But Judge Richard Owen
replied, “I just wish you had
thought of that two years ago.”
A federal grand jury in New
York and a Senate Judiciary sub
committee have been looking into
allegations that Vesco attempted
to help Libya obtain military
transport planes from the United
States by corrupting U.S. officials.
Day admitted last November in
his plea of guilty to the conspiracy
charge that he exaggerated to Li
byan officials his influence with
John C. White, then Democratic
party chairman, and Hamilton
Jordan, then White House chief of
staff.
“These were false, fraudulent
statements,” Judge Owen said.
“This was not political puffery, but
fraud at a high level.”
In a letter to the court, prosecu
tor Raymond Levites said Day also
lied about his influence with
White in 1979 with FBI undercov
er agents involved in the Abscam
investigation.
Levites said Day asked for
$25,000 for White for the use of
the chairman’s influence in prom
oting a package of thermal energy
proposals before the Department
of! ^Energy.
Later, the prosecutor said, Day
confirmed that White knew no
thing of the money or the scheme.
He admitted he intended to claim
he paid off White when, actually,
he had kept the money for himself.
The judge ordered Day to sur
render to the U. S. Marshal in New
York on March 10 to begin serving
his sentence. The conspiracy to
defraud charge to which he
pleaded guilty carried a maximum
five year penalty.
The charge, in a criminal infor
mation, accused Day of falsely
representing that Jordan agreed to
use his influence on behalf of
Libya. Day, the charge con
tinued, also lied when he said he
met with Jordan and White in
Texas where they “agreed to enter
a corrupt venture.”
