houses of prostitution be closed.
“We care enough about this city to
try to uphold the law. ”
But there was no cheering at the
Old Style No. 10, a bar named after
the Deadwood saloon where Wild
Bill Hickok was shot to death Aug. 2,
1876.
“I think it’s a stupid decision, and
I’ve lived here all my life,” said Lin
da Ford, who works at the Old Style
No. 10. “I honestly don’t think they
ever bothered anyone.”
The judge had granted the state’s
request for a preliminary injunction
in June, but the houses actually had
been closed since a May raid by
state, federal and local authorities. A
federal grand jury, which convened
following the raid, failed to return
any indictments.
Congressman warns paper
that use of ad will libel him
“Obviously the judge is following
what the law clearly makes illegal,”
Lawrence County State’s Attorney
Craig Grotenhouse said. “Whether
it is a victory for the community of
Deadwood, I don’t know that. Dead-
wood is going to have to look at itself
in the future.”

located below some of the brothels
said, “I think they should be open.
They weren’t doing anybody any
harm, not in no way, shape or
manner. ”

DES MOINES, Iowa — Rep. Tom Harkin, D-Iowa,
warned 85 southwest Iowa newspapers they may be
dragged into a libel suit if they publish a paid advertise
ment critical of him, the Des Moines Register said
Tuesday.
The copyright story said Harkin claims the advertise
ment, called “The Hypocrisy of Tom Harkin, ” is being
placed in the newspapers by the John Birch Society.
Harkin’s letter to the newspapers, marked “not for
publication,” was not a threat, the congressman said,
but an attempt to notify the papers they could become
involved in a lawsuit he plans to file against the group
that placed the ad.
“It is not my intention to seek legal redress from any
newspapers in the 5th Congressional District,” he said.
“Such action may be unavoidable.
“Somebody’s got to stop these bully boys. I’m getting
tired of these bully boys of the right placing these ads.
I’m tired of being bullied around by these people and
I’m going to take them on in a legal context.”
Harkin said the advertisement is “a reprint from a
recent issue of‘The Review of the News,’ a publication
associated with the John Birch Society.”
“I personally consider the article libelous and I have
discussed this with an attorney knowledgeable in this
area who also agrees that the article provides the basis
for legal action,” Harkin told the Register.

HADDAM, Conn. — The Con
necticut Yankee nuclear power plant
released a small amount of radioac
tive gas into the atmosphere for six
minutes Tuesday, the second such
release in less than two weeks, offi
cials said.
Northeast Utilities spokesman
Everett Perkins said the “very small,
unplanned radioactive release”
occurred at the plant at 4:20 a.m. He
said the release did not exceed any
federal limits and posed no danger to
the public.
Perkins said the release was re
ported to the Nuclear Regulatory
Commission and state and local offi
cials because it was unplanned.
On Sept. 26 Connecticut Yankee
leaked radioactive gas into the
atmosphere for more than three mi
nutes.
Northeast, which operates the
state’s three nuclear power plants,
said the earlier release was caused by
a technician who accidently opened
the wrong valve.
Perkins said engineers were trying
to determine how Tuesday’s release
occurred and exactly how much gas
leaked into the atmosphere.
He said the maximum dose of
radioactivity at the plant boundary
measured .003 millirems. The aver
age annual dose of radioactivity re
ceived in the area from naturally
occurring sources of radiation in the
| area is 55 millirems, he said.
“There would be no danger to the
(public,” Perkins said.
No acquittal
of FBI chiefs
for break-ins

WASHINGTON — A federal
judge, rejecting defense arguments
that prosecutors had failed to prove
their case, refused Tuesday to order
the acquittal of two former FBI
chiefs charged with approving illegal
break-ins.
Lawyers for former FBI No. 2 man
W. Mark Felt and retired bureau
intelligence chief Edward S. Miller
now are likely to call a parade of de
fense witnesses for testimony that
could extend four weeks or more.
In arguing for acquittal after 13
days of prosecution testimony, de
fense lawyer Thomas Kennelly con
tended the break-ins in 1972 and
1973 were part of a legitimate nation
al security investigation — a hunt for
fugitive radicals.
But chief U.S. District Judge Wil
liam Bryant said: “Suppose I had
three children, and suppose during a
particular political situation ... my
| children break away and join a radic-
| al group.
“Are you telling me somebody has
| a right to sneak in my house and go
| through my effects?”
Kennelly said such a search was
[legal to gather intelligence in a na
tional security probe.
But prosecutor John W. Nieles Jr.
[said the searches at the homes of
acquaintances and relatives of fugi
tive leaders of the Weather Under
ground organization violated “the
very core of the Fourth Amend-

Strip mining
rules OK’d

WASHINGTON — Interior Sec
retary Cecil Andrus Tuesday
approved coal strip mining regula
tions proposed by Maryland and
Louisiana but rejected parts of t&e
reclamation programs submitted by
Virginia and West Virginia.
Andrus said the failure of Virginia
and West Virginia to have their en
tire programs accepted would not
affect interim federal surface mining
grants or impose new obligation* on
coal operators.
“Both these critically impottfaMit
coal states have made great strides4n
achieving primacy and we have ev
ery belief they will be successful
upon final review in January,” said
Andrus.
He said his agency would work
very closely with the two states to
