Report says action slow on Billy
Civiletti waited to check with president first, claims New York Times

WASHINGTON — The Senate Committee investigat
ing Billy Carter s Libyan dealings Thursday turned its
attention to a report that Attorney General Benjamin
Civiletti delayed action to force Carter to register as a
Libyan agent until he could check with President Carter.
The special Judiciary subcommittee called in Joel Lisker,
head of the Justice Department’s Foreign Agent Registra
tion Unit, for a cross examination about apparent conflicts
in testimony given to the panel by Civiletti and Lisker.
The New York Times reported Thursday that Robert
Kelly, Republican counsel for the committee, dealt with
the conflict in a memorandum distributed to GOP mem
bers of the panel and given to the Times by a staff
member.
The Kelly report said Lisker testified that when he told
Civiletti that Billy Carter acknowledged receiving money
from Libya, the attorney general told Lisker not to act on
the information for 10 days, the Times said.
Billy Carter has denied any attempts to influence his
brother, the president, in return for a $220,000 payment
from Libya. He has called the payment a loan.
Chairman Birch Bayh, D-Ind., planned an executive
session during the day to consider possible disciplinary
action against the committee source who leaked the GOP

Times quoted the report as saying.

report, sources said. They said there was no implication
Kelly himself leaked the story.
Kelly’s report noted Civiletti had told a press conference
the department’s criminal division alone had handled the
Billy Carter case, but suggested Civiletti’s instruction that
Lisker delay action contradicted that.
“This amounts to circumstantial evidence that Civiletti
wanted time to talk to the president to see if he could get
Billy to register, thus avoiding criminal prosecution for
refusing to do so,’ the Times quoted the report as saying.
Bayh told reporters Wednesday he has no plans to call
Billy Carter back to the witness table, but the president’s
brother may be asked to submit sworn testimony to clear up
any discrepancies that crop up.
One point of concern was Lisker’s written report that
Carter denied in January he had any commercial dealings
with Libya, although he had already received a $20,OK
advance on a promised $500,000 loan. He said Carter repe
ated the denial again in June.
Carter, who registered as an agent of Libya in Julylo
settle a Justice Department lawsuit, has denied giving Lis
ker any misinformation. But during his recent testimony,
Carter said some statements he made later about what was
said at the meetings may have been inaccurate. ■ jfy wea p,
Bayh told reporters Wednesday the subcommittee is V “i n this

their testimony, especially that of Ali El Houderi, headofB
the Libyan mission.
The subcommittee would also like to confirm that
the $220,000 Libya ultimately paid Carter was actually*
loan — as Carter claims — and not payment for his
publicized friendship with that country’s radical regimeoi
other services.
Another question was whether they tried to use the
president’s brother to influence U.S. policy toward Libya,
or to obtain release of planes they had purchased in this
country.
Houderi recently told the Washington Star he would be
willing to testify if he can avoid being questioned abouthis
country’s role in international terrorism. He confirmed the
$220,(XX) was a loan, not a payment for services.
