Ninety prospective jurors have been sum moned to the court of Chief U.S. District Judge Robert D. Morgan for Monday’s open ing of the case against ComEd and two ComEd employees. The trial is expected to last one to three weeks. The defendants are accused of falsifying records and conspiring to cover up the utili ty’s failure to comply with a Nuclear Regula tory Commission security plan for ComEd’s Quad Cities Nuclear Power Station between January 1976 and April 1977. Attorneys and utility officials say the case could set security standards for the nuclear power industry nationwide. The Justice Department said the indict ment returned against ComEd in March was the first ever returned against a nuclear power company. Three months later, a more powerful in dictment superceded eight counts of the original indictment addressing defense con tentions that ComEd had no duty to report security infractions. Whether or not there was a legal duty to report the violations, the new indictment said, plant officials illegally falsified security records to cover them up. The indictment said guards were ordered to falsify records by omitting reports of unes corted visitors and unlocked and unguarded doors in the plant’s protected and vital areas. ComEd, a Chicago-based utility that serves 2.9 million customers in northern Illinois, owns several operating reactors and has six more under construction. The Quad Cities plant is located at Cordova on the Mississippi River — in a metropolitan area with some 350,000 residents. Indicted with the utility were Nicholas] Kalivianakis of East Moline, the Quad City plant’s superintendent, and Walter E. Meehan of Morrison, a former security di rector. ComEd was charged in all nine counts while Kalivianakis and Meehan were indicted on seven. Each count carries a maximum penalty of five years in prison and a $10,00(1 fine. The prosecution, led by special attorney David W. Elbaor of the Justice Departments criminal division, is expected to call at least 25 witnesses, including former plant security guards and officials from ComEd and the NRC. II of I side citie T sity mer stun Tl Jan. I 1 ultii that bore Samuel K. Skinner, a former U.S. attorney for northern Illinois, will head the defensefoi ComEd. The utility is paying for separate legal counsel for Kalivianakis and Meehan.
