Anderson must obtain 41,000
valid signatures by July 14 to get his
name on the Nov. 4 general election
ballot in Texas and he said he was
willing to go to court to do so.
“I’m convinced on the basis of an
enthusiastic corps of volunteers that
we have a very realistic, indeed an
excellent, chance to meet the re
quirements of your laws, ” Anderson
told reporters after attending a fun
draising breakfast.
Although Attorney General Mark
White has clouded the issue by rul
ing Democrats voting May 4 can not
sign Anderson petitions, the Repub
lican congressman from Illinois said
his backers would continue soliciting
signatures from those voters based
on an opinion from Texas Secretary
of State George Strake.
Anderson said the secretary of
state ruled because the Democratic
primary was only a non-binding
“beauty contest” that did not deter
mine national delegates, that the vo
ters were eligible to sign the peti
tion. The Republican primary was to
select delegates and people who
voted in it can not sign Anderson
petitions.
“We don’t see why they (Demo
crats) should be barred from signing
our petition,” Anderson said.
Asked whether he would go to
court to contest White’s ruling,
which Anderson termed “purely an
advisory opinion,” the candidate
said: “We ll litigate if necessary to
preserve the right to be on the ballot,
but we’re not going around bran
dishing the sword. We hope to settle
it amicably.”

Union deduction

AUSTIN — A state district judge Tuesday denied a request by the
Texas Right to Work Committee for a temporary restraining order
prohibiting Comptroller Bob Bullock from deducting union dues from
the checks of state employees.
District Judge Herman Jones scheduled a June 9 hearing on the
merits of the suit challenging Bullock’s planned dues checkoff prog
ram, and told attorneys he is concerned about an apparent lack of
authorization in state law for a union dues checkoff system.
Attorney General Mark White has ruled the deductions are legal
because there is no prohibition against them.
“I don’t find anything in labor statutes that would make this deduc
tion any different from a deduction for the Salvation Army, but I don’t
find any authorization for deductions for the Salvation Army either, ”
Jones said.
“It seems to me with so many Ralph Naders running around the
country they could dream up thousands of sweet things for administra
tive agencies to do if they were turned loose to make whatever deduc
tions were desirable.”
Two state employees and the Texas Right to Work Committee filed
suit challenging the proposed union dues checkoff program, which
Bullock has said he will implement in June.
But Warren G. Craig Jr., attorney for the plaintiffs in the suit,
agreed not to press for a restraining order against the comptroller if the
case could be considered by mid-June.
Craig contends payroll deductions may be made only for items
specifically authorized by the Legislature, and said bills dealing with
union dues checkoffs failed in the 1979 Legislature.
“I just don’t see how an administrative agency can put an end run
around the Legislature and attempt to implement this program that in
effect regulates labor unions,” Craig said.
Craig and representatives of the attorney general’s office agreed the
only fact issue in dispute is whether Bullock’s dues checkoff program
would be conducted at state expense or whether its costs would be fully
defrayed by the employees requesting the deductions.
