AUSTIN — Railroad Commission
Chairman John Poerner criticized
his Democratic primary opponent
Wednesday for not knowing the fed
eral government sets coal-hauling
rates.
Poerner said Rep. Buddy Temple,
D-Diboll, was incorrect in saying the
Railroad Commission sets a 30 per
cent tax charged by Wyoming for
coal shipped to Texas. The commis
sion chairman, a former legislator,
said the Interstate Commerce Com
mission does the rate setting.
“When we both served in the Leg
islature, Buddy Temple was not
known for being studious,” Poerner
said. “So, it’s no surprise to me that
he is ignorant of the statutes or that
he doesn’t know about federal ICC
powers and regulations. The State of
Texas has no legal authority to
change ICC rulings.”
Poerner’s statement responded to
Temple political advertisements im
plying the commission could change
rail-hauling rates on products from
other states.
Temple countered by saying Poer
ner was a “desperate bureaucrat” un
able to justify inactivity on coal-
hauling rates.
Temple said Poerner won’t seek
rate changes, but has lobbied for a
“$20 billion Japanese ‘bullet train’
that is the biggest boondoggle of
U.S. history.”
