Tax laws offer savings

Homeowners and potential
homeowners may be losing money
by not taking advantage of new tax
laws, said Dr. Jack Friedman, head
of the research division of the Texas
Real Estate Research Center at
Texas A&M University.
“Although most people know in
terest payments and property taxes
are deductible from income taxes,
many are unaware of significant tax
changes enacted in the last few years
which can save the homeowner even
more money,” he said.
Friedman used the new $100,000
tax exemption for owners over 55
years of age as an example.
“Many build a substantial equity
in their home or homes over the
years. Congress has recognized this
situation and allows the individual to
keep the first $100,000 of gain from
the sale of one’s principal personal
residence by many individual 55
years old or older,” Friedman said.
“This is a once-in-a-lifetime break,
and the homeowner would be well
advised to seek competent tax coun
sel before taking the exemption.”
Another tax savings which people
do not usually consider is the roll
over provision.
“The roll-over provision of the tax
law states the individual can defer
taxation on the profit from the sale of
one’s principal personal residence if
the homeowner buys a more expen
sive home within 18 months. This
can be coupled with the $100,000
exemption to create a sizable estate
which can contribute to a comfort
able retirement lifestyle,” he said.
Another tax advantage of home
ownership allows the individual
buying water and sewage services
from the township or municipality to
deduct a portion of the monthly bill
from income tax. The courts have
ruled the portion of the bill which
represents assessment for mainte
nance, repairs or interest is deducti
ble. The municipality has the re
sponsibility of notifying customers
which portion of the bills are being
used for these items. This informa
tion is usually computed in early
January. Friedman suggested muni
cipal services users contact the bill
ing authority for information.

ner might consider is reduction of
fuel costs through improvements.
