Machine monitors potential jurors United Press International HOUSTON — Defense lawyers, jldng for jurors troubled by the prospect of a death penalty, used an electronic voice stress analyzer to choose a jury for a capital murder trial. Observers said it was the area’s st electronically aided jury selec tion and possibly the first ever in The trial was scheduled to begin Wednesday with attorneys Sherman Ross and Bill Frizzell representing Claude Wilkerson, charged in a 1978 jewelry robbery in which two men and a woman were shot and buried on a ranch near Shiner. Wilkerson was convicted once be fore but the earlier jury deadlocked onthe death penalty, forcing retrial. The $1,500 instrument measures microtremors in the voice that ordi narily are undetectable to the human ear. The tremors supposedly show stress and, on occasion, have been used to determine whether a respondent was being truthful. joted, t' -thew Jnceagi -eciatioa THURSDAY, SEPTEMBER 6, 1979 “We weren’t looking for decep tion,” Ross said. “We wanted to ver ify our feelings about whether they (jurors) understood the gravity of the questions concerning the death penalty. “It’s like having a clinical psy chologist sit in for jury selection,” Ross said. “A life or death decision should be one of the most stressful tasks of a person’s life.” Ross said that no juror was struck solely on the readings of the voice stress analyzer, but he said one po tential juror was struck from the panel for showing no stress at all. Wilkerson is charged in the Jan. 24, 1978, slayings of pawnshop owner Donald Fantich, 33; jewelry store owner Georgina Rose, 46, and Dr. William Fitzpatrick, 31, a radiologist and friend of Fantich. Wilkerson is first being tried be fore State District Judge Thomas Routt on a charge of masterminding the killing of Fitzpatrick. Jury selection began Aug. 13 and ended Tuesday.
