WASHINGTON — Transporta
tion Secretary Brock Adams and
congressional leaders, reacting to a
surge in train travel caused by
gasoline shortages, agreed Wednes
day to retain some Amtrak system
trains slated for retirement.
The decision on exactly which
trains would continue running after
Oct. 1 would be left to Amtrak,
using criteria for ridership and
losses to be set by Congress when it
approves the Amtrak budget this
year.
Although there is no exact way to
determine which trains would be
saved, informed sources said these
are prime candidates to continue
running:
—The Montrealer from Washing
ton to Montreal.
—An additional New York to
Florida train.
—The Crescent from Washington
to New Orleans.
—One of the two Chicago to
Texas trains.
After their hour-long, closed
meeting, however, neither Adams
nor the congressional leaders would
speculate on which trains would be
retained. Adams said that would
depend on how many people ride
the trains in the meantime.
“Let people vote by buying tick
ets,” he said.
Adams agreed to add $68.5 mil
lion to the $552 million in operating
subsidies the administration re
quested.
There was no agreement on the
exact formula to be used, and a
number of congressmen were re
ported dissatisfied and angry with
Adams’ proposals.
House Commerce Committee
chairman Harley Staggers,
D-W.Va., said the government
should be adding trains, not cutting
them. He refused to say, however,
whether he would move to freeze
the current system as is.
Sen. Frank Church, D-Idaho,
who was not at the meeting, is mak
ing a move in the Senate to keep the
system at its current size, and Stag
gers has been expected to do so in
the House.

WASHINGTON — Telephone
users cannot reasonably expect the
numbers they dial to remain secret,
the Supreme Court ruled 5-3 Wed
nesday.
This affirmed a lower-court ruling
that the warrantless installation of a
telephone recording device called a
pen register was not a constitutional
violation.
A pen register records numbers
dialed from a particular telephone.
The case was brought by a Mary
land man who was convicted of rob
bery after a pen register was used to
trace threatening calls he made to
the robbery victim, identifying him
self as her assailant.
He tried to suppress the pen reg
ister evidence on grounds its instal
lation constituted a “search which,
under the Fourth Amendment, re
quires a court warrant.
Justice Harry Blackmun, writing
for the majority, rejected that ar
gument, saying it rested on a claim
there is a “legitimate expectation of
privacy when a person dials num
bers on his telephone.
“We doubt that people in general
entertain any actual expectation of
privacy in the numbers they dial,
the opinion said. “All telephone
users realize that they must convey
telephone numbers to the tele
phone company, since it is through
telephone company switching
