DALLAS — According to Texas Christian University’s chancellor, a
abinet-level education department proposed by President Carter
ould lower the quality of education by creating an unneeded bureau-
atic “monster. ”
Carter has given high priority to creation of a Department of Educa
tion that would encompass public and higher education. Bills differing
lightly from his proposal have been passed by the Senate 72-21 and by
a House committee 20-19.
Both House and Senate versions would build the new department
ound the Department of Health, Education and Welfare’s Division
of Education, adding the Defense Department’s overseas dependents’
hools and a few programs from other agencies.
Also included would be the Labor Department’s high school equiva-
ncy and college assistance programs for migrants, HEW’s vocational
habilitation services, health professions student aid, educational
tivities of the Office of Civil Rights, college housing, law enforce-
ent scholarships and internships, and certain National Science
Foundation programs.
| But TCU’s chancellor, Dr. J.M. Moudy, says “federalization” of
education will lead to “lock-step approaches to hiring, never being able
to fire, an entrenched bureaucracy in Washington and an entrenched
aching force in the schools.
“What we have can be improved, but federalization has never
brked to improve anything,” he said.
An education department bill was passed by the Senate last year, but
Sed in the House in the rush for adjournment. The bills were passed
;ain in May despite concern among some congressmen they would
eate a new and bigger bureacracy.
Moudy agrees, noting that such a bureacracy would bring more
strictions and higher costs to education.

Muniz appeal vetoed

WASHINGTON — An appeal by
Pedro Cruz Muniz, under death sen
tence in Texas for the rape and mur
der of a 19-year-old Southwestern
University coed, was turned down
Monday by the Supreme Court.
Muniz, however, is not likely to be
executed in the near future since he
could yet pursue further state or fed
eral court appeals.
The Supreme Court acted over
the dissents of Justices Thurgood
Marshall and William Brennan, who
oppose all capital punishment.
Muniz was convicted after a trial in
Georgetown, Texas, of the Dec. 20,
1976 rape and beating death of Janis
Carol Bickham. He allegedly fol
lowed the young woman into an
abandoned bathhouse where he as
saulted her, then later hid her bat
tered body under a pile of driftwood.
The Texas Court of Criminal Ap
peals upheld his conviction and
death sentence Nov. 1, 1978.
In his appeal, Muniz argued that
the sentencing phase of his trial was
flawed by testimony of a psychiatrist
employed by the state’s attorney,
who ostensibly interviewed him in
jail to deto..nine whether he was
mentally competent.
However, the psychiatrist tes
tified during the punishment phase
of Muniz’ trial that he was an anti
social person who would commit fu
ture acts of violence. That question
was a factor in determining whether
Muniz should get the death sentence-
