WASHINGTON — An aircraft
manufacturer was guilty of discrimi
nation in grounding a test pilot be
cause of his age, the Supreme Court
ruled Monday.
The justices, returning to the
bench one man short following a
two-week recess, rejected without
comment the appeal of McDonnell
Douglas Corp., which removed
Phillip Houghton from his test
pilot’s job at age 52.
Houghton filed suit in U.S. Dis
trict Court in St. Louis, Mo., and
Judge Kenneth Wangelin ruled
against him after hearing conflicting
testimony by experts on how age
can aflect a test pilot’s performance.
But the judge was reversed last
April by the 8th U.S. Circuit Court
of Appeals.
The circuit court granted
Houghton back pay and ordered
him returned to the job of chief
production test pilot if it can be
shown he remains physically capa
ble of “safely and effectively” doing
the job.
The 1967 Age Discrimination in
Employment Act forbids unfair
treatment of workers between 40

makes exceptions in instances
where age is a crucial factor.
McDonnell Douglas claimed that
exception, but the appeals court did
not agree.
Chief Justice Warren Burger,
who spent the recess in the hospital
with a chronic back condition, was
on the bench Monday. But Justice
Harry Blackman, recuperating from
surgery in Minnesota, was missing.
In other cases Monday, the court:

PROCEDURE
For Students Completing 92 Hours at the
End of the Fall ’77 Semester
To be eligible to order the Texas A&M Senior
Class Ring, an undergraduate student must
have at least ninety-two (92) semester hours,
with 30 hours at A&M and be in good standing
with th< University. To order at mid-semester
using mid-semester grades to fulfill the above ■
requirements, please note the following in
structions:
1. Leave your name, major and I.D. number
with the Ring Clerk, Room Seven,
Richard Coke Building, prior to
November 10th. THIS MAY NOT BE
DONE BY PHONE.
2. Bring mid-semester grade report along
when ready to order to veruy eligibility.
3. All rings must be paid for in full when the
order is placed. Senior Ring loans are avail
able through student financial aid in the
YMCA Building.
4. Anyone having failed toleave their name in
advance and fail to bring their mid
semester grade report when ready to order
will be asked to return later to allow time
for records to be checked.
5. Mid-semester orders will be taken only
from October 26th until November 30th,
1977.
6. Students who do not place their order dur
ing this period may order after final grades
are posted. ,
7. The Ring Clerk is on duty from 8 A.M. to 5
P.M. each day, Monday through Friday.
However, in order for other duties to be
carried out, absolutely no orders will be

WICHITA, Kan.— Ara Cron, a
63-year-old gray-haired woman,
cannot understand why the federal
government would refuse to give
marijuana to people who are slowly
going blind.
T’m certainly going to do every
thing I can to work to legalize
marijuana for medical purposes,”
she said in a telephone interview
Sunday. “This should be available to
people if it’s helpful.”
Cron is somewhat of an expert on
the use of marijuana for the treat
ment of glaucoma, a hereditary eye
disease in which fluid builds up be
hind the eye causing pressure on
the optic nerve.
Glaucoma is a painful disease that
can end in blindness. Several
studies, however, have indicated
marijuana reduces the pressure on
the optic nerve, preventing the dis
ease from worsening.
Earlier this year. Cron’s glaucoma
took a turn for the worse. She had
severe headaches and intense pain
around her eyes. Her vision became
worse each day.
H er doctor suggested surgery,
but Cron held back. Instead, she
asked the federal government to let
her use marijuana.
“I started writing letters, I tried
every way possible, she recalls. “I
wrote to HEW, to state representa
tives, to just everybody I could
think of to obtain it legally—to no
mail from someone who hadk
of her plight.
“I don’t know if I should held

went surgery in June and the opera
tion cost her part of her vision.
“I’m very resentful that I couldn’t
have the marijuana instead of the
operation,” Cron said. “There are
some days when I just can’t read
very well at all. Heavens, yes, I was
bitter and frustrated with the fed
eral government when I came out of
surgery and couldn’t see too well.”
