before the three-woman, nine-man
jury, by pointing out small conflicts
with her trial testimony.
“The state’s position is that the
witness has been impeached on
prior inconsistent statements,” said
Marvin Collins, an assistant Tarrant
County district attorney.
After a lengthy review of the law
that occupied much of the morning
session, District Judge George
Dowlen permitted as evidence a
sworn affidavit made by her on Aug.
12, 1976.
The prosecution said the latter
interview coincides with testimony
Mrs. Davis has made in the trial.
Assistant District Attorney Joe
Shannon Jr., asked by reporters to
explain the two versions given to in
vestigators, said they made the sec
ond interview after concluding sev
eral points needed clarifying.
“You can’t even tell a joke the
same way twice, ” he said.
The inconsistencies centered on
three points in Mrs. Davis’ tes
timony, including whether she
noticed the elaborate security sys
tem at the mansion was off before or
after she entered the mansion the
night of the shootings, whether she
saw the gunman return inside the
house and whether he was holding
or wearing a long black wig.
Phil Burleson, another of Davis’
attorney, said during a recess that
the defense opposed introduction of
the statement because it failed to
solve any significant disputes in her
testimony.
“We felt that her testimony had
been sufficiently impeached, said
Burleson. “It just forces us to get
into more area. We re glad the state
realizes that there are discrepancies
in her testimony.

Linowitz, who along with
Ellsworth Bunker negotiated the
treaty, was interviewed on the NBC
“Today” program.
The Senate must approve the
treaty to make it binding and Carter
has promised a strong grass-roots
campaign on behalf of the proposal,
which would retain U.S. protection
rights over the waterway.
