Kenneth Albert Brock was convicted of capital murder in the May 21,1974, shooting death of Michael Sedita, 31, manager of a Houston Seven-Eleven store. Brock had taken Sedita hostage when several police officers arrived at the store. Although the officers had retreated and dropped their weapons at his command. Brock still shot the store manager in the chest with a pistol. “The evidence at the guilt stage of the trial was undisputed that appellant committed a brutal and senseless murder during the course of a robbery. Appellant’s conduct was calculated and remorseless,” the appeals court ruling said. The criminal appeals court overruled Brock’s contention that the imposition of the death penalty was cruel and unusual punishment. The appeals court also rejected Brock’s 20 grounds of error attacking the jury selection procedure used in his trial. He argued 11 of the jurors were challenged improperly and ex cused from duty in violation of previous court standards. “Each of these prospective jurors stated clearly and unambiguously that he or she would never vote in any case to impose the death penalty regardless of the facts or circumstances involved. We find no error in the court’s action in excusing these prospective jurors,” the ippeals court’s ruling said. Clark said Carter’s plan deals “with only one side of the energy problem — demand” and fails “to tackle the other, and much more significant side — new supply.” He said the proposal would dam age oil and natural gas income from the University of Texas System’s .1 million acres of land in West Texas. He said independent oil and gas producers who drill 80 per cent of the wells, as well as major oil com panies, run a 20 to 1 risk against finding oil. He said the producers were waiting for government price incentives which would allow them to realize a reasonable rate of return on the high risk investments.
