Page 16 THE BATTALION WEDNESDAY, APRIL 20, 1977 Murder trial defense asks bond release in document United Press International FORT WORTH — The defense in the T. Cullen Davis murder trial has decided to push to get the de fendant released on bond, using a 113-page document of sensational, but unsubstantiated allegations. Those charges likely will force the trial to a new locale. Davis is charged with shooting and killing his 12-year-old step daughter. His application for release on bond contains allegations of drug dealing, threats and violence at the 10,000-square foot mansion months prior to the August slaying of Andrea Wilborn and Stan Farr. The writ also alleges or suggests: — That Davis’ estranged wife, Priscilla said she could make $10 million from the murders if Cullen Davis were convicted. — That Mrs. Davis was deeply involved with drugs including cocaine, marijuana, heroin and al cohol. — That Gus Gavrel Jr., who was wounded by the assailant as he walked in the mansion driveway with his date, asked an ambulance driver to dispose of two bags of marijuana while enroute to the hos pital. — That Gavrel’s father told his son to identify Davis as the man who shot him. — That Gavrel stated to more than one person he did not know who shot him. — That the murder weapon has never been found. The most crucial document to the defense is an unsigned statement which Richard “Racehorse” Haynes claims to have obtained from David McCrory, a longtime friend of Mrs. Davis. The statement, which is neither sworn to nor notarized, describes an incident in which a boyfriend of Mrs. Davis threatened to kill her. It claims she traveled across the coun try with a man identified as a defen dant in a drug possession case and cities their alleged use of narcotics and alcohol in the Davis mansion. Tarrant County District Attorney Tim Curry, who successfully op posed Davis’ attempt last year to be freed on bond, said the McCrory statement was of little legal value. Haynes said he included the statement because McCrory said it was accurate even though he re fused to sign it.
