Page 4 THE BATTALION TUESDAY, JANUARY 21, 1975 Unwed teacher demoted, loses state court battle to nature’s discrimination AUSTIN (AP) — A pregnant and unwed teacher who lost her clas sroom job was discriminated against by nature, not the school administ ration, State District Court Judge Jim Meyers ruled Monday. Harriet Wardlaw was transferred from Lyndon B. Johnson High School to a junior high school library after she told Supt. Jack Davidson she wanted to have the child but did not intend to marry. She contended she was discrimi nated against because of her sex. An unmarried male teacher who fathered a child would not have been treated the same way, she said. “There was no evidence that Dr. Davidson treated male teachers who became parents of children out of wedlock differently from female teachers who became parents of- children out of wedlock,” the judge said. “Such evidence normally would not be available since, presumably, male teachers do not reveal their fatherhood of children out of wed lock, and female teachers, at some time during their pregnancy, neces sarily reveal their motherhood. “An unmarried male teacher who advised the school administration that he was an unwed father and that he planned to share that information with his students, would, I must presume, be treated the same as Ms. Wardlaw. “The discrimination is in the knowledge available to Dr. David son, not in his treatment of male and females. Eventually, he will know when a female teacher is going to be a mother; he may never know when a male teacher is going to be a father. “Discrimination in the availabil ity of knowledge must be charged to nature, not to Dr. Davidson, the judge said. Ms. Wardlaw’s lawyer said a decision would be made later on whether to pursue the matter with the Austin school board or through the federal courts. Board to ‘spread word’ about amnesty program WASHINGTON (AP) — With only 11 days left of President Ford’s amnesty program, the Presidential Clemency Board announced Mon day its members will fan out across the nation to spread the word about the plan. Board Chairman Charles E. Goodell said they will go to the big cities, with the largest television markets, to hold news conferences and make themselves available for interviews to explain and answer questions. “I want to make it clear that this is not a recruitment drive,” but to in form “those who may be eligible so they may decide for themselves in case they care to participate,” he said. Fifteen cities have been chosen and Goodell said five or six more may be added. The decision for the board mem bers to hit the road, Goodell said was prompted by the tremendous upsurge in applications since he launched a nationwide radio-TV campaign on Jan. 6. “In the last 10 days alone, applica tions have doubled,” he said. “In addition,” he said, “we have been overwhelmed by calls from people in almost every state indi cating that they just heard about the program. This confirms what I have repeatedly stated that lack of know ledge and confusion about the prog ram is the major reason for the slow response to the clemency board program. ” Goodell was asked at a news con ference if he had presented to Ford the hoard's unanimous recommen dation that the program be ex tended. He said not yet and that he is circulating for comment a memo to the Defense and Justice depart ments, which operate the methods of signing up for amnesty by those who have not been convicted. The board deals only with the 100.000 to 120,000 men estimated to have been convicted of draft eva sion and desertion during the Viet nam era. The Pentagon deals with 13.000 unconvicted deserters. The Justice Department deals with 6,200 unconvicted draft evaders. The memo, Goodell said, pro vides options for the President, in cluding extension of only the Cle mency Board’s operation, but not the other two programs.
