Also at Tuesday night’s meeting, the board discussed whether in- iunction, the board’s right to issue ^^■proceedings halting an action, ap- ^ plies to cases other than election appeals. "The debate is whether it is in- pf herent in our power. If we say it is, who s to say it s not? However we interpret it, that’s the way it is,” said board member Wesley Harris. The power of injunction in elec tion appeals was specifically granted to the board in a senate resolution passed last week. Under the resolu tion, the board can issue a 24-hour injunction stopping a disputed campaign action until the board can meet to decide the case. In the event of a candidate violat ing an injunction, board member Sam Walser said the board might be able to issue a summary judgment. Under a summary judgment, the board would automatically decide on appeal cases against a candidate violating an injunction. Also at the meeting, board member Mike Perrin presented a set of suggested hearing procedures covering rights, responsibilities and special election procedures. The rights included, knowing operating procedures in writing, calling witnesses, cross-examining witnesses and introducing pro cedural motions. Perrin listed the procedural mo tions of delaying or extending hear ings, calling mistrials, rejecting evi dence, dismissing for lack of evi dence, making extraordinary mo tions and designating attorneys. Perrin s suggested hearing pro cedures were all tabled until the next meeting when including them in the by-laws will be discussed. A motion by chairman Jerri Ward passed stating the board shall re frain from questioning during the presentation and summations of a hearing and may have unrestricted questioning afterwards. Another motion passed concern ing the vote required for a by-law amendment. Under the motion, amending a by-law takes a two- thirds majority, six members. A majority of the members pres ent is required to suspend or change a standing rule of order. The next judicial board meeting will be 2:30 p.m. Sunday in the stu dent program office.
