WASHINGTON (AP) — The Supreme Court ruled Tuesday that police may make a complete search of anyone under lawful arrest. The court’s three liberals dis sented sharply. The import of the 6-3 decision rests in the use of evidence found in such searches, and the opera tion of the controversial ‘exclu sion rule” which bans use of ille gally gathered evidence at trial. “It is the fact of the lawful ar rest which establishes the author ity to search, and we hold that in the case of a lawful custodial ar rest a full search of the person is not only exception to the warrant requirement of the Fourth Amend ment, but is also a ‘reasonable’ search under that amendment” wrote Justice William H. Rehn- quist for the majority. In dissent, Justice Thurgood Marshall said the court now was turning its back on the long-held principle that the legality of searches accompanying arrests should be assessed on a case-by case basis. The ruling came in cases that stem from traffic arrests. In one, a District of Columbia man was arrested on an out standing traffic warrant. During the search, a cigarette packet con taining heroin was found on his persons. The U. S. Circuit Court overturned his conviction for pos session of the drug, saying that tre search that discovered it went beyond permissable limits. The high court majority reversed that decision. In the second case, police in Florida were permitted use as evidence marijuana discovered in a search that followed a routine warrantless traffic stop. “A police officer’s determina tion as to how and where to search the person of a suspect whom he has arrested is necessarily a quick . . . judgment which the Fourth Amendment does not require to be broken down in each instance into an analysis of each stey in the search,” said Rehnquist. Marshall, joined by Justices William J. Brennan, declared that ‘the mere fact of an arrest should be no justification in and of itself for invading the privacy of the in dividual’s personal effects. They broke away from hard rock and started com menting on the English society with such songs as “Well Re spected Man” and “Dedicated Follower of Fashion.” This period culminated with the album “Village Green Preservation So ciety,” released in ’67. This lat est effort finds them returning to that period after spending some time doing rock music and pro viding an insight to the perform er’s personal lives and gripes. “Act 1” is very deliberate, very witty and, of course, very, very British. I love it. Favorite cuts are “Where Are They Now?”, “One of the Survivors” and “Cricket.” Not a sticky wicket in the bunch. “MOONDOG MATINEE” — The Band must have wanted to release this one for quite a while. The cover is part of a poster which finds the group standing around an establishment display ing a sign with “Jook Joint” glar ing out in big red letters. During the group’s leaner days, when they were called Levon Helm and the Hawks, before being discov ered by Bob Dylan, they must have played in more than one place that looked like this. The music comes from the fifties and early sixties with tunes such as “Ain’t Got No Home,” “Mystery Train,” “Third Man Theme,” and “The Great Pretender.” This is the most interesting experiment since Laura Nyro’s “Gonna Take a Miracle” and well worth a listen or two. You might even like it. “THE JOKER”—Now that he’s had us fooled for so long, Steve Miller is letting us in on a little secret. He never really was the Gangster of Love or the Space Cowboy or any of his other alter egos. Now he says it was all a joke. Whoever he is, the Texas transplant brought more success ful albums out of San Francisco than anyone, save the Airplane or the Dead. He was never identi fied with either the Texas sound or the San Francisco sound but rather created his own personal, unpredictable style. Right in the middle of one of his soaring guitar leads, he is apt to break into a simple little tune for no apparent reason. It’s almost like he really is playing a joke on everyone. I would like for him to get a little more serious, but I really don’t mind, simply be cause he is so much fun.
