Page 8 College Station, Texas Wednesday, October 24, 1973 THE BATTALION Lesbian Presentation Results in Dismissals A Colorado college psychology instructor was refused a second- year contract allegedly in retali ation for presenting a panel on lesbianism to one of her classes of “Psychology of Women” and is filing suit in Denver for rein statement, back salary and $100,000 in damages. Susan Brown is suing Ames College in Greeley, contending that she was denied her “pro cedural due process rights in that she was never provided written reasons for her nonretention nor a fair hearing concerning non renewal of her contract.” The National Education Association and its affiliate, the Colorado Education Association, are sup porting federal litigation on Ms. Brown’s behalf. The NEA and CEA are also supporting two other Colorado teachers filing non-renewal suits today in U. S. District Court in Denver. They are Florence Coen, a teacher at Lincoln Elementary School, Boulder Valley School District; and Donald Weathers, a teacher and basketball coach at West Grade School, West Yuma County School District. Both are seeking reinstatment, back salary and $200,000 in damages. In the Brown suit against mem bers of the College Council of Ames College and Ed Beaty, col lege president, Ms. Brown’s brief states that the panel discussion of three members of the Denver Lesbian Center was relevant to the subject matter of her course and that she had advance ap proval by her administrative supervisors to have the discus sion. The panelists answered students’ questions about sex roles, employment difficulties, married homosexuals, and child bearing. Additionally, the Brown brief contends that the nonrenewal of her contract “was accompanied with accusations concerning (her) moral character so that the non renewal imposes upon her a stigma foreclosing other employ ment opportunities in her chosen profession as a teacher, depriv ing plaintiff thereby of her lib erty without due process of law in violation of the Fourteenth Amendment.” In addition to legal assistance, Ms. Brown is receiv ing a loan from the NEA Du- Shane Emergency Fund. In the other contract non renewal suits the NEA and CEA are supporting two elementary schoolteachers who are alleging that they have been treated un- Amtrack to Bring Da l las Rail Service WASHINGTON UP)—The Na tional Arbitration Panel ruled Tuesday that the Southern Pa cific must allow Amtrack to operate passenger trains over its tracks between Dallas and Hous ton. The panel said Amtrack and the railroad each should pay half the cost of upgrading the track to make it suitable for passenger service. The decision will bring rail service to Dallas residents. No date was set for the start of service on the new route. The panel said it would ask an im- partia 1 expert to decide when “after commencement of the pro gram of improvements, service which is safe and which avoids ^unreasonable interference with the adequacy, safety and effi- cency of other Southern Pacific operations can begin.” Under the old route alignment, Amtrak's Texas Chief was op erated between Chicago and Houston over Santa Fe railroad track. This brought the train south from Oklahoma through Fort Worth and Temple, Tex., before it turned eastward to head into Houston. The new alignment will bring Amtrack trains into Fort Worth, over to Dallas, and south to Hous ton through Corsicana, Hearne, and Bryan, Tex. Towns on the old Santa Fe route between Fort Worth and Houston no longer will have Amtrak service. The Southern Pacific had ob jected to Amtrak’s proposal to use its tracks between Dallas and Houston, contending the track was in such poor condition that it was unsafe for passenger operations. It claimed it would cost $7.7 million to bring the track up to passenger operations standards. The arbitration panel ordered Amtrak and the railroad to meet and agree on the amount of money necessary to achieve at least a six hour schedule of passenger service between Dallas and Hous ton. It said the two parties also should agree on the time neces sary to implement the improve ments. Both sides were ordered to report to the panel on the results of the meeting by Nov. 12. In the Florence Coen suit against the Boulder Valley School District directors, the district school superintendent, the prin cipal of Lincoln Elementary School, and the director of the Follow Through Program, Ms. Coen is charging defendants with reneging on the evaluation pro cedures set forth in the collective bargaining agreement between the Board and the Boulder Valley Education Association. Ms. Coen’s brief states that she received satisfactory evaluations for her first two years at Lincoln, but that in 1971-72 she was not given constructive leadership and guidance by administrative and supervisory staff as provided by the district’s policies. Neither was she given oral or written warn ings by the principal of his inten tion not to recommend that her contract be renewed, also required by the district’s policies. When the principal’s unfavor able evaluation was submitted to the school board and Ms. Coen’s contract was not renewed, she filed a grievance stating that the evaluation was not made in ac cordance with the bargaining agreement and that no guidance had been provided. The board claimed the matter was not sub ject to grievance procedure. Additionally Ms. Coen is claim ing she was deprived of her academic freedom rights under the First Amendment. The ac tions of her supervisor and prin cipal in interfering with her performance of her teaching duties, interrupting and criticiz ing her performance in aid of dissident factions in the com munity were, her complaint al leges, “arbitrary and unreason able, (and) attended with malice,” Ms. Coen further contends that a parent of one of the students in the Follow Through Program stated at a public meetnig “that there was a teacher at Lincoln Elementary they wanted to get rid of.” The Coen complaint alleges that that parent “enjoyed the favor of the supervisor and principal and that the two under took not to give plaintiff con structive leadership and guid ance. . . .” SEIKO: his own little‘robot.’ A Seiko DX watch with so many fea tures he’ll find it’s like wearing a robot on his wrist. Earle, head of the Department of Engineering De sign Graphics and originator of the “Cadet Slouch” cartoon, will establish an annual award for an outstanding member of The Battalion staff. The award, $300 for the 1973-74 school year, will be called the “•Cadet Slouch Award.” “I am hopeful that this award will stimulate interest in The Battalion, and in a small way reward someone who has made signifi cant contributions through the year,” Earle said. “It is fitting that this award be initiated on the twentieth anniversary of ‘Cadet Slouch’s’ introduction to The Battalion,” he pointed out. Guidelines for selection of the recipient will be flexible so changes may be made as necessary. It will be left primarily to The Battalion staff to determine how the award is administered. Dr. Earle received his B.Arch., M.Ed. degrees at TAMU in 1955, 1962 and 1964. He joined TAMU in 1957 and was named head of the Department of Engineering Design Graphics in 1969. In 1970 he received “The Battalion Award” which recognizes a faculty or staff member who provided exceptional service to the student newspaper.
