Wood has under advisement a suit filed by Genoveva Morales, a mother of eleven children. Tes timony in her case concluded Tuesday and Wood gave her at torneys 10 days to file a brief. Uvalde school officials have an- to narcotic officers. Mirelez is charged with evasion of 1966 income taxes. He is pres ently in the Harris County Re habilitation Center, a federal institution. Bond has been set at $100,000 on the income tax eva sion charges. In 1966, according to testimony of Jack C. Hollenshead Jr., a special agent of the IRS, one of Hollenshead’s informants saw Mirelez give the money to the officers. Wood took testimony briefly from Josue Garza, a Crystal City elementary principal who has lodged a complaint of discrimina- other 10 days in which to answer, preparatory to a judgment by Wood. Most of the court record of the Garza case is contained in depo sitions and records of previous hearings concerning Garza. Wood gave plaintiff’s attorneys seven days to file a brief and another seven for the defendants to answer. No decision was made on whether final arguments would be necessary in the case, which was heard without a jury. Garza’s dismissal was followed by a walkout of Mexican-Ameri- can pupils at the end of the spring 1970 term in Uvalde. case that he knows five teachers in Crystal City who were unable to find teaching jobs in their hometown of Uvalde. Hollenshead did not specify at that time that the officers were members of the Houston Police Department. Houston Police Chief Herman Short and Police Capt. Jack Re- nois, head of the narcotics divi sion, said they were aware that the IRS was investigating mem bers of the department. Renois said he understood that the IRS investigation was “just a salary thing.” He refused to identify the officers. Short said the IRS had notified him that Houston officers were being investigated but he said nothing about any “take” was mentioned. “Those two people (the un identified officers) are about as broke as anyone I know of,” Short said. “A lot of people’s returns are checked for one thing or another.” In his testimony at a prelimi nary hearing for Mirelez on charges of evading more than $100,000 in federal income taxes, Hollenshead said his informant told him he saw Mirelez give the officers the $190,000 as “protec tion payment” in 1966. He testi fied Mirelez had “nondeductible expenditures of $235,972 in 1966. Pressed for a breakdown of the total amount, Hollenshead said some of the money was spent for furniture and a car but that $190,000 went to narcotics offi- cers as protection payments, At the preliminary hearing, aa attorney for Mirelez asked for the names of the narcotics agenta Mirelez allegedly paid off. However, a U. S. magistrate ruled out that line of questioning and the IRS agent did not answer the question. Mirelez has had numerous ar rests and convictions since 1949 on narcotics charges. He hae served time in the federal peni tentiary at Leavenworth, Kan.
