Smith entangled in nepotism confusion
AUSTIN (A*) — When Preston
Smith said Wednesday that Ben
Barnes and Frances Farenthold
perhaps should resign for nep
otism, he apparently forgot he
hired Speaker Rayford Price’s
wife in 1965.
Senate payroll records show
Barbara Price was paid $1,680
for working for Smith from Feb.
1, 1965 to May 31, 1965, when
Smith was lieutenant governor,
“Maybe Ben Barnes and Sissy
Farenthold should resign,” the
governor said in Brownsville,
After suggesting it, he said: “I’m
not suggesting it, but it should
be looked into.”
Smith’s remarks were prompted
by the resignation of Sen, David
Ratliff of Stamford, who hired
several of his own relatives while
he was in the legislature.
Earlier Wednesday, in Corpus
A&M cadets headed by Leon
ard Hernandez of San Antonio
will advise the 1972-73 Fish Drill
Team.
All eight upperclass advisors
are former marching members of
national champion Fish Drill
Teams. They will try to assemble
another national and Texas state
champion unit next fall.
Working with Hernandez, sen
ior advisor, will be juniors Rod
ney F. Johnson of Killeen and
William M. Fraser III, Texas City,
and sophomores Daniel W. Jor
dan III, Beaumont; Wilford D.
McClimans, Shreveport; Mark A.
Roberts, Killeen; Douglas A.
Thorpe, San Antonio, and Michael
W. Whitted, Houston.
Christi, Smith said: “I’m not say
ing that nepotism is wrong or
right, but Mrs. Farenthold had
them and Ben Barnes had them.
I’m kind of interested in this kin
folk thing. There might be some
others who are guilty of it.”
The nepotism law forbids leg
islators and other state officials
to hire their relatives.
The law also outlaws the hir
ing by legislators of other rela
tives of other legislators. It makes
no distinction between the House
and the Senate.
But for years it was assumed
that House members could hire
relatives of senators and vice
versa.
Atty. Gen. Crawford Martin
cleared that up on April 18 with
an opinion that declared the prac
tice violated the nepotism statute,
which carries a fine of $100 to

Fraser and Johnson marched

the 1971-72 team. Jordan was cit

Travis County Dist. Atty. Bob
Smith said Thursday he did not
have the resources to investigate
the nepotism law cases in the leg
islature. At least 75 relatives of
45 legislators have worked on leg
islative payrolls sometime in the
past five years.
The district attorney said he
had talked with the House ad
ministration office and Secretary
of the Senate Charles Schnabel
and he is convinced they are sin
cere in their promises to elimi
nate the nepotism practice.
However, the grand jury will

was named that year to the edi
torial board of “Communications
In Behavioral Biology.”
