If married people are allowed contraceptives to guard against pregnancy then the state cannot make it a crime for a single per son to use them for the same purpose, said Justice William J. Brennan Jr., in a 4-3 decision. The ruling upset the 1967 con viction of William R. Baird, a birth-control crusader, for hand ing a package of vaginal foam to a young woman attending his lecture at Boston University. Struck down also were provi sions of a 93-year-old Massachu setts law that allowed contracep tives for single people only to prevent disease and contracep tives for married people to pre vent pregnancy. Twenty-five other states have similar laws. Most, or all, appar ently will be declared void by lower courts on the basis of Brennan’s opinion. However, the decision does not prohibit Mas sachusetts or any state from lim iting distribution of medical con traceptives, such as "the pill,” through physicians and pharma cists. Brennan, the court’s only Ro man Catholic, rested the deci sion on the Fourteenth Amend ment’s guarantee “equal protec tion of the laws.” He said this means that "whatever the rights of the individual to access to con traceptives may be, the rights must be the same for the unmar ried and the married alike.” Justices William O. Douglas, Potter Stewart, and Thurgood Marshall joined Brennan, while Justices Byron R. White and Har ry A. Blackmun added their votes against Baird’s conviction for a different reason — the foam he gave the woman can be bought generally without prescription. Chief Justice Warren E. Bur ger alone voted to sustain Baird’s conviction. He said that since Baird is not a physician or pharmacist he had no right un der state law to dispense con traceptives to anyone single or married. Many of us have fought . . . will continue to fight the battle of the bulge. And some of us, alas, will lose. I have a friend whose wife is engaged in that grim struggle . . . and who is being roundly defeated. Fortu nately, my friend doesn’t seem to mind. He says, con solingly: “Who cares if you’re plump.
