COP’s Seeking [Recount Turned Down

AUSTIN — Texas Republicans
seeking a statewide recount of the
Nov. 8 election got another turn
down Wednesday from ; Democratic
state officials. 1
GOP leaders hinted their next
move may be in state or federal
courts.

lawyer Hardy Hollers filed a sec
ond request that the State Can
vassing Board hear immediate
arguments on setting an election
contest trial for Dec. 5.
Secretary of State Zollie Steak-
ley said Tuesday the three-man
board would give the Republicans
some sort of hearing before the
Dec. 8 contest deadline, but not
before hearing from the Demo-
crats ? lawyers.
Nothing New
“We have reviewed the renewal
motion and find no new matter
presented. The board stands by
its decision yesterday. We will not
proceed until the other side has a
chance to be heard,” Steakley said
after Hollers’ second motion was
filed.

Steakley said he had not heard
from lawyers for the 24 Demo
cratic electors, who are named de
fendants in the Republicans’ con
test su ( it.
“If they don’t give us a 1 favorable
answer on this renewal motion, I
see no further reason to re-urge
the preliminary hearing motion,”
Hollers said. “Time is wasting.”
He said he was convinced the
canvassing board—made up of
Steakley, Gov. Price Daniel and
Atty. Gen. Will Wilson—has no in
tention of hearing any arguments,
even on procedural matters, be
fore the Dec. 8 deadline.
There have been unverified re
ports the GOP will make a last-
ditch bid for a recount in federal
courts on a claim that Texas vot
ers’ constitutional rights will he
violated if a recount is not or
dered.

In the, renewal motion overruled
Wednesday, the Republicans said
any further delay by the board to
impound all ballots for safekeep
ing and to order a full dress trial
“would in effect cause irreparable
harm, injury and damage” to more
than one million Texans who voted
for Republican national nominees.

Connally accused Texas Republi
cans and Texas Democrats foi
Nixon of “sorry sportsmanship by-
giving aid and comfort to the
Republicans in Illinois.”
A grand jury investigation and
a recount of some votes has
started in Chicago.
State Sen. Charles Herring of
Austin said Republicans have not
tried the “simple ahd adequate
remedy” provided for election con
tests in the state constitution—by
filing contest suits in the district
courts of counties where election
irregularities are alleged.
“Of course a hearing is the last
thing these people want, because
their publicity balloon will lose its
air,” Herring said.
