After a two-month* *ummer
recea* the high court reconvened
thia month and waded into a
stack of dispute* Among inter
esting rase* either decided or due
to be decided are these:
Water right* are involved in a
ca*e filed by Southern Canal Co
of Houston against the State
W'ater Board. Southern Canal
wanted a permit to take 2S0,110
acre feet of water per year from
the Trinity River for industrial
use in the Houston area. Water
Board refused the request, and
the company appealed to the
courts.
I'pat ream cities such as Dallas
and Fort Worth had opposed the
Houston company’s request when
it was before the Board Oral
arguments were centered on
whether the courts have the right
to reviewr Water Board dwiftion*.
Supreme Court’s ruling w^ll have
implications for every person in
terested in the course of Texas’
water development.
Keeping roomers and setting
up a church in a residential area
were the cause of contention in
two cases from Houston. In both
cases certain property owners in
umvertity neighborhood* argued
that other property owners were
violating deed restrictions.
Lower courts ruled in favor of
the room renters and church
builders. Supreme Court agreed
to review the roomers' cases and
denied a motion to force the low
er court judge to move the stu
dent religious center.
Office seekers had their inning
in the usual contests arising out
of the year’s election*. George
Parr, a familiar figure in the
court*, won the right to a new
trial in hi* effort to be certified
winner In a lS»r*6 election for
Duval County sheriff.
Laredo Attorney William
Wright lost out in an attempt to
force Sec'y of State Zollie Steak- |
ley to place his name on the gen- 1
eral election ballot as a Constitu
tion Party candidate for district
judge. Steakiey had refused on j
grounds Wright voted in the
Democratic primary.
Myron love, choice of Houston
liberals, won out in a dispute
over the legality of his selection
as Democratic nominee for dis
trict judge Harris County Execu
tive Committee had ruled that no
candidate filed in time for this
office, mod love was nominated
by th# one man District Execu
tive Committee. Conservation
force* had contested this method.
Damage suita, laboi manage
ment controversey also command
ed judicial attention. A gas ex
plosion in the basement ut Dallas'
Baker Hotel, back in 1M6, is the
basis for one suit in whit'h 8.'<
petitioners ask some Sl,(NNl,(HK)
for deaths and injuries. High
court sent It back to district
court for new trial.
In Houston 311 workers of the
AFL-CIO Office Employe* Union
picketed a construction project to
protest the finag of one man. A
lower court granted an injunction
against the picketers, and the
Supreme Court refused to inter
fere.

make a fiddle, but the varnishing

A (50-foot aluminum tower has
been erected for use in the initial
phase of a research project being
conducted for the Texas Transpor
tation Institute for the State High
way Department.
Charles J. Keese of the Depart
ment of Civil Engineering, and re
search engineer. Texas Transpor
tation Institute, in in charge of
the research project, an investiga
tion of the effect* of highway
lighting on traffic operation.
Working with Keese is William
R. McCasland, instructor in the De
partment, and a research assistant
in the Transportation Institute.
Purpose of the investigation,
which Keese says will probably
continue for at least a year, is
to determine the effect* of differ
ent degrees of intersections! light
ing on traffic behavior.
The tower, located near High
way 6, will be used to perfect the
procedure for making motion pic
ture* of highway traffic at night.
Keese and his staff have made
night motion pictures of traffic
in the past. Just recently, how.
ever, a new highly sensitive mo
tion picture film has been devel
oped, and it will be used in the
tower tests to determine if the
quality of the traffic pictures can
be improved.
While the night filming proce
dure is being tested, various inter-
j sectional lighting arrangements
1 will be studied on a scale model
' of an intersection. The model is
s now being prepared by the Archi-
I tectural Research Group of the
Texas Engineering Experiment
I Station.
Following the initial phase of
the research project, the investi
gators will set up their filming
'equipment at a state highway in-
! tersection. The intersection will
be lighted to provide a field lab
oratory to check the conclusions
arrived at from the model studies.
